!NOTES: Will signed in Fannin county, TX on 30 May 1877 and filed on 21 Nov 1877: "Last Will and Testament. I James F. Duckworth of the county of Fannin, State of Texas, being of Sound and disposing mind and Conscious of the uncertainity of life, do declare and publish this to be my last will and Testament as to the disposition of my property after my death, both Real and Personal property. First I will and bequeath to my beloved wife Mary Jane Duckworth during her natural life and as long as She remains my Widow, The land on which I now reside ?? to wit namely Two Hundred and Twenty Two acres more or less of the John Norton Survey (text deleted), and also all my personal property Such as Horses, Cattle, Sheep, Hogs, Wagons, machinery, aggricultural implements and Household and Kitchen Furniture as will be sufficient to Farm herein bequeathed, and to enable her the Said Mary Jane Duckworth to give unto my younger Children the Same Amount of property when they arrive at age to receive it as I have heretofore given the older ones. I further publish and declare that Should my beloved wife Mary Jane Duckworth Survive me that She Caused to be advertised and Sold in twelve months time (40) Forty acres more or less now owned by us of the J. F. Hunter Survey of land and to have all Surplus Stock, Wagons, implements, machinery now owned by me Sold after duly advertising the same on twelve month Credit, and all my debts and liabilities settled out of the proceeds, and after Settling my debts Should there remain a Surplus of funds, said Surplus to be placed in Bank for the use of the Said Mary Jane Duckworth and Minor Children. I also publish and delcare that it is my will that the said Mary Jane Duckworth Shall manage, execute, and Carry out all the provisions herein Contained in this my last will and testament. I further publish and declare it to be my will that the boys, Padion, Soloman, Benjamin, Tobias, Alvin, Roander and John shall remain on the place, build their Houses and assist their mother to raise Brother to raise their minor Bros and Sisters, and to see that them and their mothers are properly supported. I futher publish and declare that it is my will that after the death of myself and my beloved wife Mary Jane Duckworth, the the Children take charge of all the properties left including the Homestead and all other properties both Real and Persoanl, advertise and sell same and divide the proceeds equally among themselves. And for executors of the last Clause I hereby appoint Padian and Soloman, my two oldest boys to see that this provision of my will is faithfully and Honestly Carried out. I further publish and declare that I wish my property disposed of as before Stated by the persons herein named without the aid of Courts any further than to give legal effect to the provisions herein set forth and expressed, neither to advise any of my executors herein named to give security for their official acts under this provisions of this will. In testimony of which I hereto Set my hand this 30th day of May 1877." Witnesses were Cooper Melton and John Coonrod.
