!NOTE: Equity box 52, case number 1303 in Logan county, Kentucky, states that Alfred, George, and Henry W Dalton (deceased) are sons of Berryman Dalton and that Berryman Dalton died intestate in the Fall of 1839.

!NOTE: Marriage in Pittsylvania County, VA to Sarah Cook 19 December 1805. This may be a 2nd marriage for Berryman since Henry W. Dalton was born in 1802 per Dalton Bible records.

!NOTE: Berryman Dalton served in the 4th Regt VA Militia in the war of 1812. National Archive records indicate he entered the military in September, 1814 and was discharged on December 1, 1814. His residence was Pittsylvania county, VA and he was discharged at Camp Elliatts Mills which was 340 miles from his residence. He way paid $36.33 for his service of 3 months and 19 days at $10 per month. He was a Corporal. Pay stub at "Baltimore, 12 Dec, 1814: I hereby Certify, That there is due from the United States to Berryman Dalton a Corporal in Luit Adams Company 4 Regiment of Vir Militia in the service of the United States, Twenty five and 80/100 Dolls. being the amount of his pay from 1st Oct 1814 to 18th Dec 1814 as appears from the Muster Rolls of said Comp V now in my possession, payable to him or his order." This was Greenhill's regiment.

!NOTES: Lewis Dalton is the only Dalton in Logan County, KY in the 1810 Census. This 1810 record has 2 males in the 26 to 45 age bracket and 2 females in the 26 to 45 age bracket and no one over 45. In the 1820 Census of Logan County, this Lewis Dalton has one male 26 to 45 and one male over 45. Also there is only one female age 26 to 45. From that infomation, I believe that one pair of parents were living with Lewis and his wife and that the mother of either Lewis or his wife died between 1810 and 1820. I also believe that Lewis and his wife were both under 45 in 1820. Lewis Dalton lived in Russellville. Berryman Dalton is found the first time in the 1820 Census of Logan County, KY. This family had 4 male children under 10, 2 male children age 10 to 15, and one male 26 to 44. There were also 2 female children under 10, 1 female between 10 and 16, and 1 female between 26 to 44. There are no Daltons listed in the 1840 census of Logan County, KY.

!NOTES: Berryman Dalton arrived in Logan County in about 1816 and is found in the Logan County, KY Tax roll that year. In Equity Case 9-156, 27 November, 1817, sale of the estate of Ragland Langston, deceased. Purchasers include include Beryman (sp) Dalton and others.

!NOTES: Berryman Dalton was sued the first time in 1822. Equity Case 15-348 Jackman vs Dalton, ET AL, Filed 14 September, 1822: Reuben Jackman complained that he endorsed a note in conjuction with one Berryman Dalton for Lewis Dalton at the Bank of Kentucky discounting at their Branch Bank in Russellville due sixty days after that date. The bank instituted a suit upon the note and recovered judgement thereon for the amount of the note and when execution was issued against him and the Daltons he discharged payment, etc. He states that Berryman Dalton, as he believes, is insolvent or at least that his property, if he is not insolvent, is beyond the reach of execution and that he was jointly bound with Jackman as security for Lewis Dalton. He would also state that Berryman is justly entitled is and should be compelled to pay and contend his proportionable part of the debt recovered against them. And that Berryman, as he is informed and believes, contracted with one Stephen Rutherford for a tract of land in Logan Co. for which he gave Rutherford about $500. Also he is informed that Rutherford has not title to the land, etc. Mentions that Rutherford is bound to refund the $500 to Berryman. 14 September 1822 Reuben Jackman and John Perry were bound unto Berriman (sp) Dalton, Lewis Dalton and Stephen Rutherford in the penal sum of three hundred and forty dollar. (This indicates to me that Lewis and Berryman were related.)

!NOTES: Equity Case 17-424: Dalton vs Rutherford filed 14 July 1823. Berryman Dalton complains that some time in the month of January 1817 he purchased from Stephen Rutherford 100 acres lying in Logan County between the waters of the Red River and Big Whipporwill ... For which Dalton provised to give and actually gave Rutherford five dollars per acre accounting in the whole to the sum of five hundred in notes on William I. Morton which have been paid. Before this could be settled, a filing on 13 November 1823 notes that Stephen Rutherford departed this life intestate leaving a list of children under the age of 21. On 10 July, 1824 the disposition of John Moudy taken at the office of John H. Quarles in the town of Russellville. It states that he (John Moudy) had lived with Stephen Rutherford for 7 years previous to his death with the exception of one year; that he lived with Rutherford at the time Berriman (sp) Dalton made the purchase of one hunderd acres; and that we ws intimately acquainted with Rutherford's contracts, speculations, and pecuniary affairs; and that Rutherford always made him acquainted with his intentions and designs and in fact confided everything to him. He well recollects to having heard Rutherford repeatedly say after Dalton had made the purchase of the land that he did not at the time he sold it intend to make Dalton a title to the land, but that he intended to defraud him out of it or get it back without paying Dalton back anything for the land. And Moudy also well recollects that some short time before the sale of the title bond which which Rutherford has give to Dalton for the land he heard Rutherford several times say that he got in with Dalton and had gotten his consent for the land to be sold the object of which was, as Moudy understood from Rutherford, to defraud Dalton out of the land. That he had posted paying Ruben Jackman $175 to bid on the bond, etc., and that he had gotten the bond is his own possession from Jackman and that then he asked Dalton no boot, and that he would suit agains Dalton for the rest of the place. Moudy heard him repeatedly the sales and in a laughing and boasting manner that he had taken one of the strongest suits on Dalton that has ever been taken on a man he expected. He had heard from Rutherford say many times Dalton had paid every cent for the lang. States that in June of last year he saw the assignment from jackman to Rutherford in the hands of John Perry and the assignment had been scratched off. States that Rutherford went to Frankfort in 1817 or 18 and told him he was going for the purpose of getting the title to the land he had sold Dalton in Constand A. WIlson's name for the purpose of defrauding Dalton out of it. Moudy states that he lives a mile or better from Dalton. That hs has not been in Dalton's house in tow years and he has never been in his. Moudy states that in 1822 he lived on Brown's place about two or three miles from town. 3 April 1824 Deposition of Saml Hadby: States in 1820 he was Stephen Rutherford's house. Dalton came there, and Rutherford being he bed, took a chair, and sat by his bedside. They had some conversation which Hadby did not hear. After Dlaton had gone away Rutherford said "that damned fools had been there in order to get a title for his land." I asked him if Dlaton had paid him for the land. He said "yes," that he had the title, but did not mean to make it; that Dalton had treated him badley about a stray stear and that he meant to cheat him out of the land that he had sold him. About the time that Dalton's bond on Rotherford for the land was sold by Saml Ownes, Deputy Sheriff, perhaps a short time after, Rutherford told Hamby, with an oath that he had taen one of the strongest pulls upon Dalton that had ever been taken on him in his life. That he had procured the bond to be sold and Jackman to pruchase it. That he was to give Jackman $175 in calls in the bank, and to Wilson he had paid $300 in the bank for his servies in repect to laying the warrant his (Wilson) name covering the land, etc. He further told Hadby that they were fixed upon a plan to scare Dalton away from the land, that he had sent him a letter in the name of William Stewart directing Dalton to leave the county before the leaves fell, or that he would share the same fate that Ward had done, who had been killed. States none was present when that conversation took place except Rutherfords oldest child who is now about 15 years old. That John Moudy was present and might have heard the conversation as he spoke to him about it afterwards. He was asked whether he and the widow and Owens have not been so much at variance as to abuse each other very violently and whether they have ever reconciled. He answered that he has never abused his daughter, the widow, voilently, but had been a variance. Mentions that Rutherford was in fear that Dalton would burn his property. 29 January 1825: Dispostion of Samuel Caldwell. States that Dalton sold the bound to secure his creditors. He talks of assignment of the bond between Jackman and Rutherford. (74 pages)
