Benjamin was probably born in Randolph County, Georgia. The name of the county was later changed to Jasper county, Georgia. When his father, Benjamin, Sr. purchased land in Jasper in 1809, the family is listed as living in "Randolph". When his father entered the 1807 Georgia Land Lottery, he is listed as living in Jackson County - a distance northeast of Randolph County. This Benjamin spent most of his growing-up years in Jasper (Newton) County and moved to Harris County, Georgia with his parents in 1828. He was living in his parents household when the 1830 census was taken. Now, how do we know that this Benjamin Milam is our ancestor? First, from the Uvalde (TX) County History, we learned that James Lafayette Milam's father was Benjamin and that James L. was born in Georgia and raised in Alabama. The 1850 census of Tallapoosa County, Alabama showed Benjamin Milam in the Daviston area of the county, with wife, Louisianna, son James (born GA), Caroline, etc. - obviously James L.'s parents family. Soon we located the Will of a Benjamin Milam, Sr. who had died in Harris County, Georgia in 1832. It listed his wife, Chary, and his children. Among them is sons, Benjamin, Dudley, Lewis, Jordan and Bartley. Also daughters, Nancy Clyatt (or Cliatt), Polly (Mary) Smith, and Elizabeth Chapman. The 1840 Georgia census shows Benjamin, Bartley and Lewis still in Harris County. In 1850 in Tallapoosa County, Alabama we find Benjamin and his family, Jordan and his family and James & Mary (Polly) Smith - all in 24th district, near Daviston. This establishes that the Benjamin Milam, father of James L. is the same Benjamin Milam listed as a son in the Will of Benjamin, Sr. in Harris County, Georgia. Harris County borders Alabama and only Chambers County Alabama separates it from Tallapoosa County. He and Louisianna must have been married about 1832 because their first son, James Lafayette was born in 1833 when Louisianna was just 15 years old. We have studied extensively the marriage records in the Harris County courthouse at Hamilton. It appears that a marriage license was not required and all of the registrations of marriages were entered after the marriage - and not necessarily in chronological order. It was as if they were recorded whenever someone thought of recording them. We have never been able to find this marriage record so will probably never know the maiden name of Louisiana. He and his brothers, Jordan and Dudley served a few days in the Georgia Malitia together in 1836. He and his family are enumerated in the 1840 census of Harris county, and from later census records it can be determined that the family moved to Alabama about 1842. It seems that his sister, Mary and her family (Smiths) moved about the same time. Perhaps brother, Jordan also moved at this time but I have not determined that as yet. He owned a 160 acre track of land [ NE 1/4 of Section 20, Range 24, Township 24] and another 40 acre plot just to the east of it, but not adjoining [if the description is correct] The description of Jordan's property is "Sect. 20 of Range 20, Twp. 24". That would make Jordan's land 24 miles west or Benjamin's! I believe the description should be "Sect. 20. Range 24, Twp. 24. that would place Jordans land adjoining Benjamins on the west. One of the census records, perhaps 1860, shows Benjamin's son, James and Jordan's son, James in consecutive households, which would indicate that they lived close together. We have known this fact for several years but only recently (1994) have been able to prove that they were First Cousins. I did not find either Benjamin or Jordan Milam in the early deed records of Tallapoosa County, but did find S. W. Monk.

Early History Of The Davisoton Area states: "The Oldest Original Deeds went to S. W. Monk in 1836 and to Benjamin Milam in 1844. Other early landowners were Jim Milam ........." Benjamin was a farmer and must have been a successful one. At the time of his death in 1863, at the age of about 55, his estate was quite substantial. Because of his wife and several minor children, the Probate of his estate was not finished until 1879. This was during and just after the Civil War and the value of the land had diminished to a very low figure. And, Louisianna and the minor children had required subsistence from it. By this time the amount divided between the heirs was less that $50.00 each. The Dunn family lived in this area also. They must have been the parents of Martha Dunn who married James Lafayette. Four of their sons served in the Confederate Army and 3 of them lost their lives. A new church was constituted near Daviston on 25 November, 1855, and it was called "Christian Union Church". Prior to the founding of the church, five members of the family had professed their faith - James L., 17th June; Martha, 19th August; Benjamin, 16th September; Lucy and daughter, Caroline, 21st October - all in 1855. The name of this church may have been changed to either Darian Primitive Baptist or to Rocky Mountain Primitive Baptist. The later, we visited, about 3 miles south of their farm. Some of the Dunns are buried there in more recent graves. There are a lot of graves that you can mo longer read the inscriptions on. This may be where they are buried. However, Darien Primitave Baptist Church is Eest of Daviston and about 4 or 5 miles from the Milam homestead.

We have no record of Louisianna's death but it was after 1870. In one census she was called "Lucinda"; in another she was listed as "Lucy"; and in another she was listed as "Louisianna".
