Benjamin Milam, Sr. was probably born in Virginia. Robert M. Wilbanks, IV, in his research, found Sammuel Milam, his father, listed in Henry county, Virginia in the 1782-1787 tax rolls. His research has established beyond any reasonable doubt that This Benjamin is the son of Samuel Milam & Sarah Kemp.

The 1790 South Carolina Federal census lists five Milam families in all or South Carolina. It includes a Benjamin Milam in York, county, Samuel Milam in Abbeville county and a Benjamin Milam in Laurens county. The Benjamin in York county has been identified as the son of John Milam and he moved back to Virginia. The Benjamin in Laurens county is the only Benjamin who has not been identified in this time period. This 1790 census of Benjamin shows 1 male over 16 and 1 female over 16. This would indicate a young married couple, probably newlyweds - with no children.

Deed book D, page 203 for Laurens county, South Carolina shows Benjamin Milam witnessing a deed dated 9 Dec 1791 where Sylvanus Walker and wife sold 40 acres to Ambrose Hall. Deed Book E, page 38 [same county] dated 9 Dec 1791 indicates that Benjamin purchased, for 30 pounds, from Sylvanus Walker and wife, 200 acres bounded by Hardy Conant, Thomas Dendy, Cornelius Cargill, Thomas Jones, John Cargill and Ambrose Hall. In the same deed book, page 40, Benjamin witnesses a deed for sale of land to Thomas Milam on 22 Aug 1793. The 1800 South Carolina census does not show him to be in that state. It can be presumed that the family migrated to Georgia between 1793 and 1800. [All of the previous is from Robert M. Wilbanks, IV "Milam Roots" newsletter] It can be narrowed down more than that by referring to the death notice of son, Lewis. He was born in 1798 South Carolina.

In 1807 Benjamin, of Jackson County, Georgia, entered the Georgia Land Lotteries that had been created to distribute the Cherokee Indian Land to new settlers. He was not successful in this drawing, but on 7 Apr 1807 he bought Land Lot #10, District 18;, Baldwin County from Arthur Jenkins for $500.00. Mr. Jenkins had won it in the lottery. Randolph County was later made out of part of Baldwin County. It was named for a Sgt. Randolph, a Revolutionary War hero. It turned out that Sgt. Randolph got into some kind of trouble and was disgraced. The county was renamed "Jasper" in honor of another Revolutionary War Sergeant who had distinguished himself. This story was told to me at Monticello, the County Seat, by a Mr. Waite who, in later years, had been a Jasper County Commissioner. Mr. Waite also told the story of a man who built a tavern on the highway north or Monticello and when he tried to get license in Jasper county, it was denied because Jasper County officials claimed it was in Newton county. Newton county claimed that it was in Jasper county! TODAY this property is considered in Newton county and we saw it on the aerial maps in the Newton County Tax Office in the courthouse at Covington, Georgia. It is located near where state highway #83 crosses the Jasper-Newton county line.

The 1820 Georgia Census lists B. Milom in Jasper County, page 252, Monticello District. It shows 2 males under 10, 2 males 16 to 26, 1 male over 45, 1 female 10 to 16, 2 females 16 to 26 and 1 female over 45.

In 1827 Benjamin, a resident of Jasper County entered the 5th Land Lottery. This drawing gave some special considerations to Veterans of the Revolutionary War and the War of 1812. He entered as a Revolutionary War Veteran. He was successful in this drawing and was awarded Land Lot #171, district 5, Troupe County. The lot was granted 13 Jan 1828. Harris County was established, in part from Troupe County and Benjamin's lot ended up in Harris county. It is very close to the point where, today highway I-85 crosses the Georgia-Alabama border and not far from West Point, Georgia. Both of the "Land Lots" mentioned here contain 202 1/2 acres.

1830 census of Harris County, Georgia, page 180 lists this Benjamin and in the household is 1 male 15/20 (Bartlett?), 1 male 20/30 (Benjamin?), 1 male 70/80 (Benjamin), 1 female 20/30 (Mary?), and 1 female 50/60 (Chary). Also in 1830 census is Jordan (40/50) in Pike county, page 112; Lewis (20/30) in Harris county, page 176; Thomas F. (40\50) in Newton county [proved later to be living on Land Lot 10, District 18, formerly owned by Benjamin]. Also in 1830 census is a Dudley Milam in Henry county (50-60) who, I believe, is too old to be Benjamin and Chary's son but maybe the younger brother of Benjamin. Could Thomas F. Milam be a son of this Benjamin, also? He was not mentioned in his Will.

The above listed age of Benjamin (70/80) arrears to be incorrect according to other known facts. I wonder if it shound have been checked in the 50/60 age group; or, did he "fibb a little" on his age to claim Revolutionary War status for the Land Lotteries. and, when the census was take only 2 years later, he was "stuck" with it. We know when his older brother, Bartlett [the first child of Solomon and Sarah], was born: we know Chary's approximate age; we know within a year or two the date his children were born. Everything indicates that he was several years younger than was enumerated in the 1830 census! Our early research was confusing when we found a "Dudley Milam" who was near the age of Chary but still young enough to have been the son, Dudley, named in his Will. It appeared that Chary might have been a second wife and Dudley a son from his first wife! Rpbert M. Wilbanks, IV research cleared it up when he found that the older Dudley was a brother and that this Benjamin was not as old as the 1830 census indicated. We have not found the marriage record of Benjamin and Chary. It's very probable that they were married in South Carolina.

Benjamin, Senior, died in Harris county in 1832 and his Will is recorded in Book 1 of early Georgia Wills. He must have been very successful in lifetime. He left a fairly substantial estate to his heirs. His son, Bartlett
